SPECIAL NOTICE TO CALIFORNIA CUSTOMERS UNDER THE CALIFORNIA ONLINE PRIVACY PROTECTION ACT

California customers may request information about our disclosures of certain categories of nonpublic personal information to certain third parties for their direct marketing purposes.   • Income information, to evaluate your ability to repay any loan offered to you;
  • Employment information, to help us confirm the source of your income;
  • Information regarding your credit worthiness, to evaluate your willingness to repay any loan offered to you;
  • Your military status, in order to comply with the Military Lending Act and related state laws;
  • Your banking account information, including debit card information in certain circumstances, to allow you to conveniently pay your loan through our payment portal or through a pre-authorized electronic funds transfer.

SOURCES OF THE CATEGORIES OF PERSONAL INFORMATION

Our primary source for the information listed above is you. We collect most of the information from you at the time you apply for one of our loan products.
In some cases, we may collect personal information about you from third parties. Third parties from whom we collect your personal information may include lead generators, our own company affiliates, or consumer reporting agencies.
In some cases, we may share (but not sell) your personal information to third parties. Third parties with whom we share your personal information may include lead generators, our own company affiliates, consumer reporting agencies, our banking partners, and governmental entities that routinely examine our business practices.

ACCESS TO SPECIFIC PERSONAL INFORMATION

Under certain circumstances, the CCPA allows a California resident access of his or her personal information by requesting disclosure of specific pieces of information, or by requesting identification of categories of personal information. In responding to requests for access, the Company will use reasonable methods for verifying that you, as the individual making the request for access, are the consumer about whom the Company has collected information. Reasonable methods of verification will be tailored to the particular circumstances of the request, but they may include asking for identification or using a third party identity verification service.
The Company will acknowledge receipt of your request within ten (10) days of receipt and advise of any verification needed to complete your request. The Company will then generally respond to your request within 45 days. In the event that the Company cannot respond within 45-day deadline, we will send you an explanation as to why and respond no later than 90 days after your request is submitted. The Company may, however, deny your entire request or a portion of your request for specific personal information if:

  • We cannot verify your identity;
  • The disclosure creates a substantial, articulable, and unreasonable risk to (a) the security the personal information requested, (b) your account, or (c) the Company’s systems or networks;

  • Due to a conflict with other state or federal law.

If your request to delete is granted due to the absence of an exception, the Company will separately confirm your request before doing so.

SALE OF YOUR PERSONAL INFORMATION

The Company does not and will not sell your personal information within the meaning of the CCPA. Because the Company does not sell your personal information, you are automatically opted-out of the sale of your personal information. In the event the Company changes its practices in this regard, the Company will update this policy and provide an avenue for you and other consumers to opt-out of such sales.

  • Charge you different prices or rates for products or services, including by granting discounts or other benefits, or by imposing penalties;
  • Provide you a different level of service;
  • Otherwise discriminate against you for exercising your rights.

However, as permitted by California Civil Code section 1798.145, we may charge you a reasonable fee for our costs associated with complying with your request.

YOUR CHOICES

You may express a preference for receiving telephone and e-mail contacts from us. Specifically, we may send you e-mails or call you regarding our services from time to time.
